1.1 Introduction and Acceptance
Welcome to BowTel (“we,” “us,” “our,” or the “Platform”). BowTel is operated by BowTel Canada Operations Inc., a corporation incorporated under the laws of the Province of Alberta, Canada, with its principal office in Calgary, Alberta.
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and BowTel Canada Operations Inc. governing your access to and use of the BowTel website at bowtel.vacations, mobile applications, and all related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
Substitution of contracting party (effective 2026-05-19). Earlier versions of these Terms named a different entity as the contracting party. By accepting this version, you agree that BowTel Canada Operations Inc. is substituted as the contracting party in place of any entity named in any prior version, and you ratify any booking, listing, or other transaction you have entered into through the Platform as if it had been entered into with BowTel Canada Operations Inc. from the outset. Your rights and obligations carry forward unchanged; only the named counterparty is updated.
These Terms apply to all Users of the Platform, including:
- Guests — Users who browse, search for, and book short-term rental accommodations
- Hosts — Users who list, offer, and manage short-term rental properties
- Visitors — Users who browse the Platform without creating an account
1.2 Eligibility
To create an account and use the Services, you must:
- Be at least eighteen (18) years of age or the age of majority in your province or territory of residence, whichever is greater;
- Have the legal capacity to enter into a binding contract;
- Not be a person barred from receiving services under the laws of Canada or any applicable jurisdiction;
- Not have been previously suspended or removed from the Platform.
Canadian residency is not required to use the Services. International Users may use the Platform subject to these Terms and any applicable laws in their jurisdiction.
1.3 Account Registration and Verification
1.3.1 Account Creation
To access certain features of the Services, you must register for an account by providing accurate, current, and complete information, including your:
- Full legal name
- Valid email address
- Telephone number
- Date of birth
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.3.2 Identity Verification
BowTel may, at its discretion, require identity verification through:
- Email verification
- Phone number verification
- Government-issued identification (for certain Host or Guest features)
- Additional verification as reasonably required for trust and safety purposes
1.3.3 Account Security
You agree to:
- Maintain strong, unique passwords for your account;
- Immediately notify BowTel of any unauthorized use of your account;
- Not share your account credentials with any third party;
- Not create more than one account per person.
BowTel is not liable for any loss or damage arising from your failure to maintain account security.
1.4 The Platform — Role as Intermediary
1.4.1 Marketplace Model
BowTel is an online marketplace that connects Hosts with Guests. BowTel is not a real estate broker, property manager, hotel operator, travel agency, or insurer.
BowTel does not own, manage, or control any properties listed on the Platform. When a Guest books a property through the Platform, the resulting rental agreement is between the Host and the Guest. BowTel is not a party to that agreement.
1.4.2 No Endorsement
The listing of a property on the Platform does not constitute an endorsement, certification, or guarantee by BowTel of:
- The quality, safety, or legality of the property;
- The accuracy of listing descriptions or photographs;
- The Host's compliance with applicable laws and regulations;
- The suitability of the property for any particular purpose.
1.4.3 Payment Facilitation
BowTel facilitates payments between Guests and Hosts through our payment processor, Stripe. BowTel collects payments from Guests on behalf of Hosts and transfers funds to Hosts according to the payout schedule described in the Host Terms of Service. BowTel is not a bank, financial institution, or money services business.
1.5 Bookings and Payments
1.5.1 Booking Process
A booking is confirmed when:
- The Guest submits a booking request with valid payment information;
- For instant-book listings, the booking is automatically confirmed upon payment authorization; or
- For request-to-book listings, the Host approves the booking request within the specified timeframe.
A confirmed booking creates a binding agreement between the Host and Guest, subject to the applicable cancellation policy.
1.5.2 Pricing and Fees
All prices on the Platform are displayed in Canadian Dollars (CAD) unless otherwise stated. The total price for a booking includes:
- Nightly rate — Set by the Host
- Cleaning fee — Set by the Host (if applicable)
- Guest service fee — Charged by BowTel to the Guest
- Payment processing fee — The cost of processing the payment, passed through to the Guest
- Applicable taxes — As required by law
BowTel's Guest service fee and payment processing fee are disclosed before booking confirmation and are non-refundable except where the Host cancels the booking.
1.5.3 Payment Terms
- Standard bookings (fewer than 28 nights): Full payment is charged at the time of booking confirmation.
- Long-term bookings (28 nights or more): Payment is collected in monthly installments. The first installment (covering the first month's stay plus applicable fees) is charged at booking confirmation. Subsequent installments are charged on a monthly basis.
- Payment methods: BowTel accepts payment methods supported by Stripe, including major credit cards, debit cards, and other payment methods as made available.
- Currency: All transactions are processed in Canadian Dollars (CAD).
1.5.4 Security Deposits
Hosts may require a security deposit for their listing. Security deposits are authorized (but not charged) at the time of booking. Deposits may be claimed by the Host for property damage in accordance with the Security Deposit Policy. Unclaimed deposits are released automatically after the claim period expires.
1.6 Host Obligations
Hosts agree to:
- Provide accurate and complete listing information, including descriptions, photographs, pricing, availability, and house rules;
- Maintain all required short-term rental licences, permits, and registrations as required by their municipality, province, or territory;
- Comply with all applicable laws, including zoning bylaws, fire safety codes, building codes, health regulations, and tax obligations;
- Comply with all applicable tax obligations (including registration, declaration, filing, and payment of GST/HST, QST, provincial accommodation taxes, and income tax) for Host activity on the Platform. Where BowTel collects and remits accommodation taxes on behalf of the Host under section 5.4.2 of the Host Terms of Service, BowTel's collection and remittance does not relieve the Host of any of their other tax obligations;
- Maintain the property in a safe, clean, and habitable condition;
- Honour confirmed bookings except in cases covered by the cancellation policy or force majeure;
- Respond to Guest communications in a timely manner;
- Comply with all applicable anti-discrimination laws and the BowTel Anti-Discrimination Policy.
Additional Host obligations are set out in the Host Terms of Service.
1.7 Guest Obligations
Guests agree to:
- Provide accurate personal information during registration and booking;
- Use booked properties only for their intended purpose as short-term accommodations;
- Comply with the Host's house rules and any applicable building or community rules;
- Not exceed the maximum occupancy specified in the listing;
- Treat the property with reasonable care and report any damage promptly;
- Vacate the property by the agreed check-out time;
- Not engage in any illegal activity on the premises;
- Comply with all applicable laws during their stay.

1.8 Cancellations and Refunds
Cancellation and refund terms vary by listing and are determined by the cancellation policy selected by the Host for each listing. The applicable cancellation policy is displayed to the Guest before booking confirmation and is captured in the booking terms snapshot at the time of booking.

1.9 Dispute Resolution
1.9.1 Between Hosts and Guests
BowTel provides a dispute resolution process for issues arising from bookings. The process follows a three-stage escalation:
Stage 1 — Direct Resolution: Hosts and Guests are encouraged to resolve disputes directly through the Platform's messaging system within 72 hours of the issue arising.
Stage 2 — BowTel Mediation: If direct resolution fails, either party may file a dispute through the Platform within 16 hours after checkout. BowTel will review the dispute and may mediate a resolution, including determining refund amounts where appropriate. BowTel's mediation decision is binding with respect to any funds held by BowTel.
Stage 3 — External Resolution: If a party is not satisfied with BowTel's mediation decision, they may pursue resolution through:
- Mediation administered by a mutually agreed mediator in Calgary, Alberta;
- Binding arbitration administered under the Arbitration Act (Alberta), conducted in Calgary, Alberta; or
- The courts of competent jurisdiction in the Province of Alberta.
1.9.2 Between Users and BowTel
Any dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
The parties agree to submit to the exclusive jurisdiction of the courts of the Province of Alberta, sitting in Calgary, for the resolution of any disputes.
1.9.3 Class Action Waiver
To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
1.10 Limitation of Liability
1.10.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BowTel does not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free;
- The results obtained from the Services will be accurate or reliable;
- Any property listed on the Platform will meet your expectations;
- Any defects in the Services will be corrected.
1.10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOWTEL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING ANY HOST OR GUEST;
- ANY PROPERTY LISTED ON THE PLATFORM;
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
- ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER HARM RESULTING FROM YOUR USE OF THE SERVICES OR ANY PROPERTY BOOKED THROUGH THE PLATFORM.
IN NO EVENT SHALL BOWTEL'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO BOWTEL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).
1.10.3 Indemnification
You agree to indemnify, defend, and hold harmless BowTel, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Services;
- Your violation of these Terms;
- Your violation of any applicable law or the rights of any third party;
- Any content you submit, post, or transmit through the Services;
- Any property you list on the Platform (for Hosts);
- Any damage to property or personal injury arising from a booking (for both Hosts and Guests).
1.11 Intellectual Property
1.11.1 BowTel's Intellectual Property
The Services, including all content, features, and functionality (including but not limited to the BowTel name, logo, design, text, graphics, and software), are owned by BowTel Canada Operations Inc. and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
1.11.2 User Content Licence
By submitting content to the Platform (including listing descriptions, photographs, reviews, and messages), you grant BowTel a non-exclusive, worldwide, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, and display such content in connection with the operation and promotion of the Services.
You retain ownership of your content. You represent and warrant that you have all necessary rights to grant this licence and that your content does not infringe any third party's intellectual property or other rights.
1.11.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Services may be used by BowTel without obligation or compensation to you.
1.11.4 No Automated Access or Scraping
You may not use automated tools, bots, scrapers, or scripts to access, collect, or copy listing data, pricing, photos, or any other content from BowTel without our written permission. This includes tools that simulate human browsing behaviour. Bulk extraction of data from BowTel for any purpose — including competitive research, price monitoring, or republication — is prohibited.
1.12 Termination
1.12.1 Termination by You
You may close your account at any time through your account settings or by contacting zenith@bowtel.vacations. Account closure does not release you from obligations arising from bookings confirmed before closure.
1.12.2 Termination by BowTel
BowTel may suspend or terminate your account at any time, with or without cause and with or without notice, including for:
- Violation of these Terms or any BowTel policy;
- Fraudulent, abusive, or illegal activity;
- Conduct that harms other Users, third parties, or BowTel's reputation or interests;
- Extended inactivity;
- As required by law.
1.12.3 Effect of Termination
Upon termination:
- Your right to access and use the Services ceases immediately;
- Confirmed bookings may be cancelled in accordance with the cancellation policy;
- Any amounts owed to BowTel become immediately due;
- Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.
1.13 Force Majeure
Neither BowTel nor any User shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, epidemics, government actions or orders, war, terrorism, civil unrest, labour disputes, power failures, internet or telecommunications failures, or acts of God (“Force Majeure Events”).
In the event of a Force Majeure Event affecting a booking:
- Cancellation may be permitted outside the standard cancellation policy;
- BowTel will determine applicable refunds on a case-by-case basis;
- BowTel is not liable for losses arising from Force Majeure Events.
1.14 Modifications to Terms
BowTel may modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on the Platform with a new “Last Updated” date;
- Sending an email notification to the address associated with your account at least thirty (30) days before the changes take effect.
Your continued use of the Services after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and close your account before the effective date.
1.15 General Provisions
1.15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
1.15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
1.15.3 Entire Agreement
These Terms, together with the Privacy Policy, Host Terms of Service, Guest Terms of Service, and all other policies referenced herein, constitute the entire agreement between you and BowTel regarding the Services.
1.15.4 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. BowTel's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
1.15.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without BowTel's prior written consent. BowTel may assign its rights and obligations without your consent.
1.15.6 Notices

These Terms are drafted in English. In the event of a conflict between the English version and any translation, the English version shall prevail.
